These Terms of Service ("Terms") govern your access to and use of lodeX Pro (the "Platform"), a produced-water management platform operated by Paelode Systems LLC ("Paelode", "we", "us", or "our"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Eligibility and Use of the Platform
 

• Authorized Users: The Platform is intended solely for use by licensed oilfield hauling companies, operators, and disposal facilities ("Authorized Users").

• Permitted Use: You agree to use the Platform only for lawful, internal business purposes and in compliance with all applicable local, state, and federal regulations.
  Account Security: You are responsible for safeguarding your account credentials. You agree to notify Paelode immediately of any unauthorized use of your account. Paelode is not liable for any loss or damage arising from your failure to protect your login information.

 
2. Intellectual Property Rights
 

• Ownership: Paelode retains all right, title, and interest in and to the Platform, including all software, source code, databases, functionality, designs, audio, video, text, photographs, and graphics.

• Restrictions: You may not copy, modify, reverse engineer, decompile, or attempt to extract the source code of the Platform without our express written permission.

3. SMS Communications
 

• Consent: By providing your mobile number, you expressly consent to receive transactional and operational SMS messages from Paelode Systems, including one-time verification codes, dispatch updates, and operational job alerts.

• Opt-Out & Support: Message and data rates may apply. You can opt out at any time by replying **STOP**. For assistance, reply **HELP** or contact Paelode support, or your employer.

 
4. Data and Privacy
 

• Your use of the Platform is also governed by our Privacy Policy, which can be found at www.paelode.com/privacy. By using the Platform, you consent to the collection and use of data as outlined in that policy.

5. Disclaimer of Warranties
 

• The Platform is provided on an "as-is" and "as-available" basis. Paelode makes no warranties, express or implied, regarding the accuracy, reliability, or uninterrupted availability of the Platform or the data generated through it.

6. Limitation of Liability

• To the maximum extent permitted by law, Paelode Systems LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes, without limitation, loss of profits, data, use, goodwill, or operational delays arising out of your use of or inability to use the Platform.

7. Governing Law and Jurisdiction
 

• These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, without regard to its conflict of law principles. Any legal action arising under these Terms shall be brought exclusively in the state or federal courts located in Oklahoma.
